General Terms and Conditions

1. Applicability

These Terms and Conditions apply to all treatments, consultations, product purchases, and services provided by ODA Skin Clinic.

By booking an appointment, undergoing a treatment, or placing an order through our webshop, you agree to these Terms and Conditions.

ODA Skin Clinic reserves the right to amend these Terms and Conditions. The version applicable to any agreement is the one in effect at the time the appointment or order is made.

2. Bookings and Appointments

Appointments can be scheduled online or by telephone.

We kindly advise you to arrive a few minutes before your appointment. In the event of late arrival, the treatment time may be shortened or the appointment may be cancelled if required by the schedule.

For certain treatments, a deposit may be required. This deposit will be deducted from the total treatment cost.

3. Cancellations and Rescheduling

We reserve our time exclusively for you. Therefore, we kindly ask you to cancel or reschedule your appointment no later than 72 hours before the scheduled treatment.

Appointments can be cancelled or rescheduled free of charge up to 72 hours before the appointment.

In the event of cancellation or rescheduling within 72 hours, any deposit paid will not be refunded.

In the event of a no-show or cancellation within 72 hours before the appointment, we reserve the right to charge a €50 cancellation fee if no deposit has been paid.

In cases of force majeure, we are happy to work together with you to find a suitable solution.

4. Treatments

ODA Skin Clinic performs treatments in accordance with the professional guidelines applicable to skin therapists.

Before every treatment, we discuss your skin condition, wishes, expectations, and any relevant medical information. Based on this, a personalized treatment plan will be created.

Although we strive to achieve the best possible results, we cannot guarantee a specific outcome. Skin responses vary from person to person and depend on various factors, including lifestyle, health, medication, and skin type.

ODA Skin Clinic reserves the right to refuse or postpone a treatment if it is considered medically irresponsible.

5. Medical Information and Consent

The client is responsible for providing complete and truthful information regarding their health, medication, pregnancy, breastfeeding, allergies, and any other circumstances that may affect the treatment.

By consenting to the treatment, the client declares that this information has been provided truthfully.

If it appears that essential information has been withheld, ODA Skin Clinic cannot be held liable for any resulting consequences.

For clients under the age of 16, written consent from a parent or legal guardian is required.

6. Client Records

ODA Skin Clinic maintains a digital client record containing only the information necessary to provide safe and responsible treatment.

This record includes treatment details, health information, and any photographs of the skin that form part of the treatment process.

Clients have the right to access their records in accordance with applicable laws and regulations.

Medical records are retained in accordance with the statutory retention period established under the Dutch Medical Treatment Contracts Act (WGBO).

7. Confidentiality and Personal Data

ODA Skin Clinic treats all personal data confidentially and processes it in accordance with the General Data Protection Regulation (GDPR).

8. Photographs

During the course of treatment, photographs may be taken to document the progress of the treatment. These photographs form part of the client's medical record.

Photographs will only be used for marketing purposes, such as on our website or social media channels, if explicit prior consent has been obtained.

This consent may be withdrawn at any time.

9. Payment

Treatments must be paid immediately after the appointment unless otherwise agreed in writing.

ODA Skin Clinic reserves the right to adjust its prices at any time. Price changes will not affect appointments that have already been confirmed.

If an invoice is provided for submission to a health insurance provider, the client is responsible for submitting the claim. ODA Skin Clinic cannot guarantee reimbursement by the health insurance provider.

10. Health Insurance

Certain skin therapy treatments may be eligible for reimbursement through supplementary health insurance.

The amount reimbursed depends on the client's individual insurance policy.

ODA Skin Clinic is not liable for the full or partial rejection of claims by a health insurance provider.

11. Products and Webshop

Products purchased through ODA Skin Clinic are subject to the Shipping and Returns Policy published on our website.

For hygiene reasons, opened or used skincare products cannot be returned.

LED masks, devices, and other products are subject to the conditions stated in the Shipping and Returns Policy.

12. Complaints Procedure

We strive to provide the highest standard of care and service.

If, unfortunately, you are not satisfied, please contact us as soon as possible so that we can work together to find a suitable solution.

ODA Skin Clinic complies with the Dutch Healthcare Quality, Complaints and Disputes Act (Wkkgz) and is affiliated with the Complaints Desk for Paramedics (Klachtenloket Paramedici).

If we are unable to resolve the matter together, you may submit your complaint to the independent disputes committee with which ODA Skin Clinic is affiliated.

13. Liability

ODA Skin Clinic performs treatments in accordance with the professional standards applicable to skin therapists.

Every treatment involves a certain degree of risk. You will be informed of these risks before the treatment.

ODA Skin Clinic is only liable for direct damage resulting from demonstrable negligence and only up to the amount paid out under its professional liability insurance.

ODA Skin Clinic is not liable for damage resulting from the client providing incorrect or incomplete medical information or failing to follow aftercare instructions.

14. Gift Cards

Gift cards issued by ODA Skin Clinic cannot be exchanged for cash.

Gift cards are valid for one year from the date of purchase and may only be used for treatments and products offered by ODA Skin Clinic.

15. Governing Law

All agreements between ODA Skin Clinic and the client shall be governed exclusively by the laws of the Netherlands.
